Texas Files SCOTUS Election Lawsuit

Texas Attorney General Ken Paxton

Texas Attorney General Ken Paxton is asking the U.S. Supreme Court to block the battleground states of Georgia, Michigan, Pennsylvania and Wisconsin from casting “unlawful and constitutionally tainted votes” in the Electoral College.

In the suit, he claims that pandemic-caused changes to election procedures in those states have violated federal law, and asks the U.S. Supreme Court to block the states from voting in the Electoral College.

Predictably, the Dems howl. Poetrooper sends.

Texas Attorney General Ken Paxton filed a lawsuit against the battleground states of Georgia, Michigan, Pennsylvania, and Wisconsin in the U.S. Supreme Court over unconstitutional changes to election laws.

“The four states exploited the COVID-19 pandemic to justify ignoring federal and state election laws and unlawfully enacting last-minute changes, thus skewing the results of the 2020 General Election,” a press release states. “The battleground states flooded their people with unlawful ballot applications and ballots while ignoring statutory requirements as to how they were received, evaluated and counted.”

The defendant states made the 2020 election less secure, Texas argued in the lawsuit. “Those changes are inconsistent with relevant state laws and were made by non-legislative entities, without any consent by the state legislatures,” the lawsuit states. “The acts of these officials thus directly violated the Constitution.”

Steve Vladeck, professor at the University of Texas School of Law, opines,

“For all of the (many) lawsuits that President Donald Trump and his supporters have filed challenging the 2020 election results, the new winner for hubris and cynicism may be the action that the state of Texas filed directly in the Supreme Court late Monday night, asking the justices to throw out the results in four (but only four) battleground states: Georgia, Michigan, Pennsylvania and Wisconsin. So far, 17 states have filed motions backing the Texas attorney general, and Trump has asked the Supreme Court to let him join the lawsuit, as well.”

Not a Dem, but I’ve been ‘howling’ too – with laughter, at each and every loss the Trump team has faced. SCOTUS already declined to hear one case; I’d bet this one is laughed at too.

That said, I’d love to see “Lyin’ Ted” argue it in front of SCOTUS.

That case was tenuous at best. While I think their challenges to the PA ballot changes by fiat are entirely legitimate, that they didn’t raise them before the election seems to be the critical issue, legally speaking.

From another: “I think it is VERY important that they did not kick the Kelly/Parnell case because it specifically addresses lower level races in cheating states. While the Texas suit may end up resolving the presidential race, it would leave senators and congressmen who benefited from the same cheating in place. The Kelly/Parnell case will allow SCOTUS to order relief in lower level races too (probably that relief would be ordering new elections and not allowing the seating of congressmen/senators who also benefited from the big steal)”

I’ll agree with that totally. If they’d filed the suit before the election it wouldn’t look like they’re sore losers and trying to change the rules of the game after it’s played. That’s why it’s getting push back from the judges.

Welp, good luck with all of this there Mr Attorney General. No one can seem to get it thru their thick heads that the fix is in. The plan has been to get rid of Trump since Nov of 2016. The career swamp dwellers of both parties knew that if they didn’t imprede his progress that their continued rape and selling out of the American Republic would cease.

Well, good. Would opine that this is the case. And, yes, there is a bit of desperation in that opinion. Not much time left, and very few options left to correct the attempt to steal this election.

At least there are multiple states signing on. It seems rather simple to me – if one state skews the results of voting in their state, it effects my vote, your vote, and that of every other citizen voting around the country.

But it will be thrown out by SCOTUS without hearing by tomorrow afternoon.

This was merely an attempt to gain Trump’s favor by a corrupt criminal Texas attorney general in order to get one of those pardons Trump handing out in exchange for political, and legal favors.

The fact that 17 attorney generals joined in shows how craven and anti democratic the republicans party has become under Trump.

A lawsuit which points out that four states changed their election procedures while not going through the state legislatures – which is what must be done according to the Constitution – is not a serious lawsuit?

The Constitution is not a piece of paper, Lars. It is the law of the land. Article II says that state legislatures decide how electors are chosen. State legislatures use popular vote to do so. State legislatures set up how that vote is conducted and when voting takes place.

In these four states, deals were struck with governors, secretaries of state, or state supreme courts to change the rules. State legislatures were not involved.

Under Article II, that is unconstitutional. The Article specifies “state legislatures.” There’s no mention of governors, secretaries of state, or state supreme courts. There’s just one way to do it and these four states (one of which I live in) botched it completely.

Not a serious lawsuit? You’re not a serious human being.
