US President Donald Trump has pardoned his former national security adviser Michael Flynn.
President Trump has pardoned his first national security adviser, retired General Michael Flynn, who spent years enmeshed in a bizarre legal war with the government that sprang from the Russia investigation.
Trump announced the news Wednesday on Twitter as Americans prepared to observe the Thanksgiving holiday this week.

Even the Justice Department knew this case stunk to high heaven, and remained mute on the matter except to state the pardon was an appropriate use of presidential power.

Democratic leaders lambasted President Trump for pardoning his former national security adviser Michael Flynn on Wednesday, condemning the move as a “brazen” abuse of power.
House Speaker Nancy Pelosi, D-Calif., said that Trump’s act was one of “grave corruption” and said that Flynn “must be held accountable” for a “serious and dangerous breach of our national security.”
“President Trump’s pardoning of Michael Flynn, who twice pleaded guilty to lying to the FBI about his dealings with a foreign adversary, is an act of grave corruption and a brazen abuse of power,” Pelosi said in a statement. “Trump is again using the pardon power to protect those who lie to cover up his wrongdoing.”
Trump announced the decision Wednesday in a tweet after months of speculation that he would pardon his first national security adviser, who had pleaded guilty twice to knowingly making false statements to the FBI about a conversation he had during the presidential transition period with the then-Russian ambassador.
Flynn later worked to withdraw his guilty plea in January 2020. In May, the Justice Department (DOJ), after initially defending the prosecution, reversed its position and began looking to drop the charges against him. His legal case had since stalled, after U.S. District Court Judge Emet Sullivan resisted the DOJ’s request and appointed a judge to determine whether Flynn should be held in criminal contempt for perjury.

According to Harvard Law School Professor Laurence Tribe, “Anyone pardoned by Trump would lose most of the 5th Amendment’s protection against compelled testimony that might otherwise have incriminated the pardoned family member or associate, making it much easier for DOJ and Congress to require such individuals to give testimony that could prove highly incriminating to Trump himself.”

If the pardoned refused to testify, Mark Osler, a University of St. Thomas Law School professor, said Congress might respond by holding them in contempt, leading to a second pardon.
“We could go to a second round of the abuse of the pardon power,” Osler said. “I mean if you’re willing to do it in the first place and abuse it that way I don’t see what the break would be in doing it at the second level.”
That should twist things up nicely for years to come, with perhaps a SCOTUS resolution. Not to mention what a defense attorney may find in discovery.

There may an order of operations from the court of findings to the court of appeal and then, given sufficient merit, the SCOTUS may become a venue.
The suck of the whole story is that Flynn did plead. Sullivan did caution Flynn and his counsel about making a plea.
Sullivan seems to have taken exception about the conflicted pleadings, admitting guilt as an expedient.
Flynn has been hosed on this scheme from the outset. Somebody really, really wants to suppress him.
In the redux… duress, coercion, expedience, it can be argued that Flynn made false statements to the court.
Sheesh, you might think that judges get used to defendants trying to optimize their circumstances.
What is the legal risk to lawyers who advise conduct that later turns out to be perjury?

Must disagree with you on that. He is VERY likely to be a criminal as well. His certitude about the outcome of the election suggests that he is part of the conspiracy and fraud which resulted in hundreds of thousands of illegal ballots being inserted into the election totals. His choice of words and the ferocity with which he projected those words were telling. He exposed himself as having knowledge of an impending criminal act before that act was committed.
The FBI has always had corruption and ethics issues. They have an amazing PR team that somehow sets them up as above reproach despite ample evidence of decades of corruption that goes back to their founding.
