Prosecutors will seek again the death penalty for convicted killer Scott Peterson in the slaying of his pregnant wife and unborn son nearly 2 decades ago.

Friday’s decision came as a county judge threw out his underlying conviction because of a tainted juror.

The case will be reexamined after the court found a juror committed “prejudicial misconduct” for failing to disclose that she had been involved in prior legal proceedings. Richelle Nice, the juror in question, had filed a lawsuit to obtain a restraining order after her boyfriend’s ex-girlfriend harassed her.

Scott Peterson returned to a Stanislaus, Calif., court — albeit virtually — for the first time in more than a decade on Friday for a hearing regarding his murder conviction in the death of his wife, Laci, and their unborn son.

Peterson, 47, wore a blue top and a blue face mask for the 8:30 a.m. PT court appearance at Stanislaus County Superior Court, where prosecutors revealed they intend to retry the death penalty phase of Peterson’s case. Peterson appeared from San Quentin State Prison, but did not speak at all throughout the hearing.

In addition to the death penalty, Friday’s hearing addressed the institution of Peterson’s legal representation. He was represented during the hearing, in part, by his former co-counsel, Pat Harris. Harris said Friday he would be representing Peterson as private counsel.

The hearing was adjourned until Nov. 6.

On Oct. 14, the California Supreme Court ordered his conviction to be reexamined to determine whether Peterson should receive a new trial. And in August, the Supreme Court overturned Peterson’s death sentence, citing “significant errors” in the jury selection process.

Not that it really matters in CA. Even if they give him the DP again, he’ll die of old age before they get around to him.

IIRC, one of the last assholes who took the needle in CA was Tookie Williams, and that was in 2005.

One reason I’m not a big fan of the DP. What good is a sentence if you don’t carry it out.

The death penalty is a joke in the Commissar’s Commiefornia. IIRC the last time it executed one of the hundreds of its death row prisoners was about almost two decades ago. Newsom has said he will
not sign any death warrant on any prisoner no matter how heinous his crime because he doesn’t personally believe in the death penalty. So, Newsom should just give Peterson a commutation or pardon.

How long did it take Charlie Manson to meet his punishment? He was given the death penalty, but die in prison. The waiting room must have been overcrowded where he was going.

His death penalty was one vacated when California’s death penalty statute was ruled unconstitutional in about 1977, as a result of a U.S. Supreme Court decision.

Peterson was sentenced under the replacement death penalty statute which was ruled constitutional. Manson and anyone sentenced to death under the old statute cannot be executed.

Like California has all kinds of spare bucks laying around to fund the endless appeal process that will follow a meaningless death penalty sentence.

The turd is 58 years old–sentence him to 50 more–he’ll die in prison and won’t have all the anti-death penalty fanatics pushing the appeals process.
