Iraq War Vet Commits Suicide After Being Charged with Shooting BLM Attacker

The NewAmerican reports that an Iraq Marine veteran and bar owner committed suicide after he was indicted for shooting James Scurlock, a BLM protester that attacked him and his father.

The former Marine who shot and killed a Black Lives Matter “protester” in self defense has committed suicide, yet another victim of a new rule in major cities in the grip of BLM terror: A white man cannot defend himself or his property, no matter the circumstance.

Jacob Gardner, a Purple Heart recipient and veteran of the Iraq War, shot himself in Portland on Sunday, five days after a grand jury in Douglas County, Nebraska, indicted him in the death of BLM attacker James Scurlock.

On May 30 during the BLM riot in Omaha, Scurlock and two other thugs attacked Gardner and his father outside the younger Gardner’s bar in Omaha.

The chief prosecutor decided not to charge Gardner, but then surrendered to BLM pressure and petitioned a judge to appoint the special prosecutor who convinced a grand jury to indict the veteran.

Apparently, he knew what was coming. The country for which Jake Gardner went to war permitted the radical Left to declare war on Jake Gardner.

He couldn’t take it. And so he killed himself.

In another article, it details the shooting and says that Gardner would not be charged… but apparently, things changed due to public pressure.

A surveillance video from Gardner’s bars, played Monday at a press conference, shows a group of young people, including Scurlock, approaching Gardner.

Walking backward, Gardner lifts his shirt to show a handgun, then pulls it to his side and continues backing up. Two people from Scurlock’s group — a man and a woman — tackle Gardner, who ends up on his back in a puddle in the street.

He fires twice into the air — he characterized them as warning shots in an interview with Omaha police. The two people run away from him.

Four seconds after that, Scurlock rushes from the sidewalk and dives on Gardner. Kleine said Scurlock was on Gardner’s back and had his arm around the bar owner’s neck. Gardner could be heard on another bystander’s video hollering, “Get off me, get off me.”

His right arm pinned, Kleine said, Gardner switched the gun to his left hand and fired over his shoulder. The bullet hit Scurlock in the shoulder-neck area, killing him.

Here is the actual video.  The conflict moves out of the frame for a while but then returns. Gardner is in the dark gray and black t-shirt.  Although I would have to say that it is hard to form an opinion based on where they chopped off the video.

How did we get here?

The evil of democrat controlled areas.

We tax you to death.

We encourage and support looters and arsonists in mostly peaceful demonstrations.

We order the police to leave the violent thugs alone and the local democrat DA will not press charges even if they were arrested.

And if you defend yourself or property, you will be brutally prosecuted. Have your licenses revoked. And bankrupted.

I’m waiting for the last straw – and that would be these cities declaring the protests a natural disaster that requires federal funding/bail-outs. They’ve already tried and failed, but will probably try again.

The solution to this is to have the CITY offer bailout money if the business rebuilds in the exact same place, and the FEDERAL bailout money is available for those that choose to relocate to another city.

We been all over and on top of this one Steveie, but it is good to keep this story in the fore front of the news. I personally think the prosecutor in this case needs to be charged with wrongful death, this hounding of a citizen that was defending his family, his business, and himself is just wrong on so many levels. And as we have seen, it was pure politics. It is sad that Mr. Gardner felt this was his only way out. I do believe I’d of taken my chances with a jury. Flip side of that, is Omaha has become like so many other cities in this country. It is full of trash, riff raff, and ne’er do wells that are in the jury pool.

Deep down I’m hoping that Mr. Gardner’s death was faked and he is in a “Witness Protection” type program running a Tiki Bar in Tahiti somewhere.

Yes, the auto-correct was funny. What the black special prosecutor did wasn’t; it was BLM pandering racism. I am sure he is now real popular with the likes of Benny Crump, who will likely be suing for Scurlock’s momma and baby momma.

Once again, this is a tough case. Apparently new evidence came to light after the prosecutor declined to charge Gardner.

According to some reports, that new evidence were texts and postings of Gardner stating he would shoot people whether or not they were creating a threat to his safety, safety of others or safety of his property.

There have been many cases of setting up circumstances that essentially eliminate a “self defense” claim which generally has to be a spontaneous reaction to a threat.

What “new” evidence that was presented to the Grand Jury will now come out as there is no case. (As well as the Grand Jury transcript.) It may be best to wait until all is known as we are only seeing a part of that evidence at this moment.

The fact that a former Marine felt the need to kill himself is troubling on many levels. Perhaps he felt that no matter the outcome of the trial, his life as he knew it was over. Perhaps he felt that the police had evidence that would convict him of the crimes. Perhaps he thought that a jury would convict him no matter what.

The death of anyone due to suicide is a tragedy on many levels. We would have hoped that Gardner would have reached out to health professionals before taking his own life but that was not to be.

Jake Gardner, a former Marine, had written on Facebook the weekend of May 30 that he was going to “pull military-style firewatch” at his bars.

As he, his father and a bouncer sat inside the bar that Saturday night, they said they thought someone had shot out their windows.

No one had. Instead, surveillance images showed Scurlock and Randall with objects in their hands as they faced the front of Gardner’s bars, 15 minutes before the fateful encounter.

Video from the scene showed a tall man whom authorities have identified as Randall hurling a signpost at the windows. Randall has denied that he is the man in the images.

Authorities have told The World-Herald that Gardner and his father did not know who they were looking for when they emerged from the bar. Soon after, however, David Gardner began pushing a woman who was walking near the bar. Seeing this, Randall sprinted a half-block and shoved David Gardner to the ground.

Gardner’s writings and posts will determine whether his state of mind was to be confrontational which precludes self defense, or whether it was self defense.

It is also important to note that the “charges” were only to proceed to a probable cause hearing and not a trial where guilt or innocence would be determined. The Grand Jury determined there was probably cause, which is only “the preponderance of the evidence.”

Like I said, there is more information and evidence out there and people need to see all the evidence and not just part of the evidence.

Um, “military-style firewatch” just means staying awake all night to make sure the AO doesn’t burn down from a short circuit, cigarette butt, coffee pot left on, etc. If authorities said that was “premeditation” for killin’ somebody, they’ll gonna feel awful stupid.
