Bergdahl lawyers say military judge’s job application posed conflict

ninja sends us the Military Times article and on the latest attempts by Bergdahl’s lawyers to free the convicted deserter.

A new motion filed in the case of former U.S Army Sgt. Bowe Bergdahl is asking the highest appeals court for the U.S. military to overturn his conviction, citing an alleged conflict of interest involving the judge who originally presided over his sentencing.

The motion filed Friday seeks to have the Court of Appeals for the Armed Forces re-examine the impartiality of retired Army Col. Jeffrey Nance, the military judge who sentenced Bergdahl. The motion says Nance was working to secure a job with the Department of Justice at the time of his ruling in the Bergdahl case.

The appellate judges upheld Bergdahl’s conviction earlier this year in a narrow 3-2 decision when they held that disparaging comments made about Bergdahl by the late Sen. John McCain and President Donald Trump in the White House Rose Garden back in October 2017 did not invalidate his prosecution.

On Oct. 16, the same day Nance accepted Bergdahl’s guilty plea, court documents show he applied for a position as a federal immigration judge.

Following Trump’s comments, Bergdahl’s attorney asked Nance to dismiss the case because of Trump’s comments “vilifying” Bergdahl.

According to court documents, Nance assured Bergdahl’s counsel that Trump’s comments would have no impact on his decision saying, “I have no hope or ambition beyond my current rank … I am completely unaffected by any opinions President Trump may have about Sgt. Bergdahl.”

But according to the motion, Nance highlighted his role as the judge presiding over Bergdahl’s case while applying to work in the Justice Department and even included as a writing sample a ruling rejecting Bergdahl’s unlawful command influence arguments.

Court documents state Nance never disclosed he was applying for a position as an immigration judge. But a press release announced his appointment to the position, by Attorney General Jeff Sessions in September 2018.

Judges like to protect each other, much the same as those wearing stars do, so I don’t expect this to go anywhere substantive. The traitor pled guilty of his own volition rather than stand trial for his misdeeds and terrorist sympathizing.

Obama was quite proud to trade five ranking Taliban for this turd who left his post to wander into the arms of the enemy. Obama’s National Security Advisor Susan Rice said Bergdahl “served the United States with honor and distinction.”

    Do you think the Taliban would return their five fighters, just to square things up?

    Then we could try this all over again (minus the part about actually going out looking for him).

    President Trump comments on SGT Bergdahl, and the left calls it “undue command influence”. President Obama says that SGT Bergdahl “served with honor and distinction”, and crickets from the other side. And how come nobody is bringing up that during those five years, he not only accumulated promotion points, but dodged all of the Combined Federal Campaign drives?

      Okay, then. I read that article and down at the bottom of it, this caught my eye:

      “…a person who under no circumstances would be a candidate for, you know, serious….”

      Throwing in that ‘you know’ phrase? That’s what tricksters do, to deflect attention from the REAL issue onto those being addressed.

      It is not unusual for deserters from the opposition in war time to be tormented by their captors, is it? Or is it just something that only occasionally happens?

      Not pointing out ‘the obvious’, just asking questions.

          I’m sure there are plenty of funding sources within the Democrat party as Bergdahl represents the textbook example of a Democrat war hero, ala John Kerry, Bradley Manning, Dicky Blumenthal and, of course, Jane Fonda.

          They’d probably like to add Hunter Biden to that heroic pantheon as well…

    They should give him the option of having the DD overturned and face a new general court martial on all counts with the added charge of misconduct before the enemy and inform him that they will be seeking the death penalty for those counts which call for it or live with what he got and go away.     Ahem… a reminder: During his captivity by the Taliban, his father Robert Bergdahl (@bobbergdahl) tweeted to a Taliban spokesman on 5/28/14:

    “@ABalkhi I am still working to free all Guantanamo prisoners. God will repay for the death of every Afghan child, ameen!” (ameen is arabic for trustworthy)

    He later deleted that tweet. CNN reported this so you know it has to be true.

      Though I’d give him the benefit of the doubt on the tweet. He could have just been trying to give the appearance of being on their side to get his kid back. Not much you wouldn’t be willing to tweet if your kid was being held captive somewhere.

      a “SECRET” security clearance is required to hold the 38B MOS, so any 38B has one. But the rest of that is just fancy talk for meaning he’s a Civil Affairs Team Sergeant (4-member team) that supports a maneuver battalion while deployed. There are a few different types of CA teams, but that’s the same basic duty position.

      That’s also a CA Battalion on Jump status and most likely the only reason he’s in that unit is because he speaks another language fluently. (They have lots of troops in other units wanting to join the few jump units for the extra pay.)

    Rice must have used her government service as the benchmark for that statement.
