Active duty Army SGT says he’s the one who shot USAF-vet BLM protestor last week in Austin

thebesig posted the original story. Now more information has come to light.

A quick recap. In Austin on 7/25, a black sedan drove through a “peaceful” BLM protest. As the car got stopped by the crowd, members of the protest swamped the car. At least one of those was armed with a rifle. Garrett Foster, who family say was a US Air Force veteran released from service early to care for his girlfriend, was fatally shot by the occupant of the sedan.

The driver has now identified himself, through a letter to the Washington Post via his lawyer. Sgt. Daniel Perry is an active duty US Army soldier stationed at Fort Hood. He says he was driving for Uber that night and had just dropped off a client. After his car was swarmed by protestors, he said a man (he initially thought was law enforcement) approached with a rifle. Perry says he shot the man, now identified as Foster, in self defense when he saw Foster raising his rifle.

I’m sure there will be a lot more to this story. As always, we’ll keep you updated.

Back in the mid 1990’s while part of 1st Maintenance Battalion, there was a Marine assigned to the Battalion who went UA to Okinawa. Apparently he rotated back stateside recently, and missed the “taco rice and cheese” of his Okinawa Honey-Ko. Her brother was “sick”, so he went back to the island on his own dime to, well, Hack doesn’t know exactly what his presence would do to make her brother better. He got busted when he went down to the US Consulate to renew his passport.

Seems to me that USAF veteran did not think this through very well. If he had just “put a ring on it” like a certain singer says, instead of gotten a discharge his “fiancé” could have been getting wonderful treatment on the governments dime. And if the Air Force is anything like the Army it would have meant all those tough assignments would not be available to him due to care and feeding requirements of his now “dependent”.

I don’t know about y’all, but in my book if someone points a firearm at me (and they are not identified LEOs) then that is a deadly threat to which I would try to respond with overwhelming force.

It sounds like the good Sgt. is of the “overwhelming force” school – 5 to center mass as quickly as possible.

I saw a still photo from the video,and the bullet stopper had the semi-auto rifle raised to his shoulder, pointed at the driver. Good shoot.
The bullet stopper’s AntiFa buddies are demanding that SGT Perry be charged. I doubt that will happen.

Given the man’s capabilities, I rather doubt he waited for his opponent to shoot.

The “reasonable fear of death” was likely established when he perceived some yahoo in an angry/hostile crowd was pointing a rifle at him, especially if said yahoo was commanding/gesturing to him in any sort of “or else” context.

But based on what I have read so far, if I was sitting on a grand jury I would be likely to say “no true bill”.

That seems so much more reasonable than, simply, the preliminary investigation found that Perry fired first.

Sounded more like a heavier pistol followed by a lighter caliber pistol to me.

Initial Police reports were that two different calibers of shots were fired (based on sounds from at least a block away). They do not specify caliber or type of weapon.
I have been unable to get the video to come up, and in the shots of the “victim” I do not see a magazine. Could his Pew-Pew have been a 9mm version?

According to the police, the deceased did not fire first, though the shooter, Perry, was apparently fired upon while escaping.

Kinda hard for him to shoot after five rounds in his ass (especially as the rifle shots happen before the five pistol shots)… guess he threw the bullets and then collapsed. Neat trick.

The article really has nothing but a few contradictory statements.

The article has a link to a police briefing where officer Katrina Ratcliffe says Perry shot, but doesn’t say Foster did. Even Perry’s lawyers don’t say Foster shot, though they do say he raised his weapon.

If this is weak, but anonymous comments suggesting Foster shot first are gospel, I don’t know what to tell you.
