President Trump Fires Prosecutor-Jerry Nadler to Investigate

President Trump fired Geoffrey Berman, U.S. Attorney for the Southern District of New York. Berman was involved with the investigations of individuals associated with Rudy Giuliani. Attorney General William Barr tried to work with Berman, behind the scenes, to get him to step down. As a bonus, Berman would be assigned to another position.

However, Berman tried to take this to social media to make it sound like his pending resignation was new to him. Barr requested that President Trump fire Berman. Berman got fired.

The standoff began late Friday night, when the attorney general released a statement saying that Berman was “stepping down.” In the announcement, he said that the president would be nominating Jay Clayton, chairman of the Securities and Exchange Commission, to succeed Berman.

Just a short time later, Berman fired off his own announcement, denying Barr’s statement.

“I learned in a press release from the Attorney General tonight that I was ‘stepping down’ as United States Attorney,” said Berman, who spearheaded the prosecution of Trump’s former personal attorney Michael Cohen and brought the grand jury indictment against associates of the president’s current personal attorney Rudy Giuliani.

“I have not resigned, and have no intention of resigning, my position, to which I was appointed by the Judges of the United States District Court for the Southern District of New York,” he said. “I will step down when a presidentially appointed nominee is confirmed by the Senate. Until then, our investigations will move forward without delay or interruption.”

NPR has more information here. Jerry Nadler and his committee may investigate this issue, but that doesn’t change the fact that the President could remove a U.S. Attorney. The letter that Attorney General Bar sent to Geoffrey Berman could be read at this link.

On day one Trump should have asked for the resignations of each and every one of these prosecutors. The problem was I don’t believe they thought they’d win so they had no plan in place for senators to provide lists of names from each state to replace these positions.

No one ever complains about Janet Reno requesting all 93 submit resignations…

Everyone of them is a political appointee to a four year term. At the pleasure of the president which is why their terms are tied to the president’s length of term.
