“The Punisher” Wants to Restrict Brand

In a bit of bad news for you superhero fans, Forbes.com writes that the creator of “The Punisher” wants to restrict the use of the image and not allow cops and fringe groups to wear it.

Police and military personnel have adopted the Marvel character The Punisher’s iconic skull as a symbol of force in recent years—but the character’s creator, Gerry Conway, told Forbes that the character was never meant to symbolize oppression, and he now hopes to reshape The Punisher for this moment in history.

You may recall that US Navy SEAL sniper Chris Kyle wore the symbol quite frequently.

 

One could even make a case that the symbol was associated with Kyle.  It even appeared in the film “American Sniper” which was about Chris Kyle.

Police officers, other military, Fox News host Sean Hannity and some believers of the QAnon conspiracy theory also became fans, and some law enforcement officers were spotted wearing the logo at the recent protests sparked by George Floyd’s death—but Conway says their usage of the logo enrages and embarrasses him.

It is not clear if the military would be prohibited from wearing it.  I guess one could always have it on a t-shirt that is covered up.

So, for many of you that may be wondering – your Punisher-themed UnderRoos may be safe for now.

Seems to me that when you offer a product for sale, people who buy that product can wear it as they see fit (of course employers, etc can limit that).
In many cases, commercial use of an image / brand can be limited through copyright and other laws, but as far as I know, when that image is licensed for use on patches, shirt, etc. that artists control over who wears it and when (again, outside of commercial instances) is over. In this current climate of stupidity, he might have some luck convincing cities / police departments/ possibly some military leaders to ban use of the “Punisher” logo, but as far as having a say in individuals wearing it, I imagine he’d have better success trying to piss up a rope…

I thought the first “Punisher” movie was good. Actors threw themselves into it, no punches were pulled, and then someone got the bright idea to do sequels, which stunk. Bright ideas always wreck the original idea.

Just flogging that Punisher icon everywhere makes it lose its real meaning, which was revenge. I particularly like the parking lot scene where all those cars were aflame in the Punisher symbol

This business of spreading it everywhere means that the people who flaunt it have no idea what the story was really about. Just plain stoopid.

The Netflix show with Jon Bernthal was pretty decent, too. His introduction in “Daredevil” made it pretty clear that he was the only superhero whose method actually worked.

P.S I own a copy of the punisher’s first appearance TASM#129 & I kept a punisher logo t-shirt I my duffle bag for 23 years on deployments.

Well, on one side you have Watterson getting royally ripped off for his Calvin (he never licensed it, all those Calvin decals etc. are pirated). But once you license and sell patches, shirts and such to the general public, you have lost control.

I think they’ll have a problem with limiting how it’s worn as long as it’s purchased legally. If there’s some legal actions take, the fun will begin when it’s association will be with the homeless dumpster divers because that’s where mine is going.

I seem to recall from a business law 101 class that if one doesn’t protect a trademark vigorously and continuously, it can effectively become moot and “generic”, thus not enforceable. The hazard is “hey, free publicity” becoming “hey! -bad- publicity! No!” with no recourse.

Caution. One’s “eh, I don’t care” will someday be repeated by a judge.

Hard to trademark a plain, white skull. DC ran into the same thing years ago when they tried to trademark the plain black Batman symbol. That’s the only reason the symbol got a yellow circle in the 60s.

Loss of trademark isn’t a new concept. The Klan co opted the battleflag of the Northern Army of Virginia, from the sons and daughters of Confederate Veteran groups. Because they didn’t disassociate their emblem from the Klan activities they lost control of the symbols and cannot disavow anything done with the Confederate symbols.
The owner of the “Punisher” trademark suffers from the same dilution and loss of control, sorts sucks to be them.

Cops shouldn’t be wearing such a symbol. A death’s head, really? It’s an example of the militarization of police that is a large part of the problem in this country.
